The Department of Homeland Security (DHS) just made another slight expansion of rules under USCIS that will convey benefits and take some people out of removal and on their way to a green card. Yesterday we were updated with regard to Parents & Spouses of Current and Former Military and Reserves Now Eligible For Green Card.
We received great news and another update from Susan Pai — an immigration lawyer who states:
The DHS made an expansion of adjudicatory authority that also makes uniform, the treatment of Visa Waiver/ESTA Green Card applicants (e.g., through marriage).
The Obama administration is chipping away areas that have needed administrative clarification for a long time and is
1.) Making them uniform across the nation,
2.) Resolving them in favor of granting legal status, and
3.) Making the changes at the benefits level (vs. with enforcement) meaning putting these decisions in USCIS hands not ICE/CBP.
The GOP was adamant we do away with bringing parents in, but the last two memos by the DHS involving veterans and the expansion via PM-602-0093 is proof the current administration is working towards positive changes from the antiquated immigration system that is broken and needs to be fixed.
The trouble is, Speaker John Boehner is reluctant to putting legal comprehensive immigration reform on the floor even though we have the votes to pass CIR now. According to Rep. Nancy Pelosi, we have approximately 191 votes in support of CIR to include 29 Republicans who vowed their support.
